11) Notwithstanding anything contained in Special Condition No.26,

the training of the nullah leading from the bridge at the North Eastern end of Lot A to the sea shore and partly on the said Lots and partly on Crown Land shall be carried out by the said Director on such lines as he shall think fit and the Lessee shall on demand pay into the Colonial Treasury a sum not exceeding $22,000 to defray the cost of such training.

(12) Any reconstruction of nullah walls roof or invert which the said

Director may consider necessary by reason of any building erected or to be erected on the Lots shall be carried out by the Government at the cost of the Lessee and the Lessee shall on demand pay into the Colonial Treasury such sum as the said Director shall certify to be the cost of such work.

(13) The Lessee shall found to such depth as the said Director may require any walls which may be erected in the vicinity of any nullah.

(14) The Lessee shall not obstruct or interfere with the existing

Government sewer between Lots A & C or the flow of water in any nullah or Water Course. The Lessee may use surplus water from any nullah or water course for flushing purposes and for t he supply of fresh water for a bathing pool or pools only. The position of any intake and the construction thereof shall be subject to the approval of the said Director. Water from nullahs may not be used for domestic purposes.

(15) The said Director and Officers authorised by him shall at all

times have free access to all sewers, nullahs or water courses on the said Lots for the purpose of effecting repairs to, inspecting, or cleansing the said sewers, nullahs or water courses.

(16) The said Director shall be at liberty without the giving of any

notice to the lessee to open up any of the said lots or any building thereon for the purpose of effecting alteration of, repairs to, inspecting or cleansing any nullah waterway or sewer and the said Director shall make such reinstatement as may be necessary.

(17) The Government shall within one year of the date mentioned in

general condition No. 14 construct a new road, as shown coloured brown on the plans attached to these conditions to the full extent shown on plan No. 2 and the Lessee shall on demand pay into the Colonial Treasury the sum of $55,000.00 towards the cost of such work. The Lessee shall not obstruct or interfere with the existing mobor road to Rural Building Lots Nos. 158 & 159 until the new road to these lots is completed and open to traffic.

(18) For the purpose of allowing access to Lots A & B rights of way

thereto from the Repulse Bay - Stanley Road shall be given over Crown Land on lines to be approved by the said Director. The Lessee shall at his own expense construct roads or paths on the pieces of ground over and along which such rights of way shall have been given at such time or times and in such manner as the said Director may direct and shall uphold maintain and repair such roads or paths and everything forming portion of or appertaining to them to the satisfaction of the said Director and shall be responsible therefor as if he were owner thereof. alteration of the public road to which such rights of way are given aborbing any portion of such pieces of ground or affecting the gradient of any road or path shall not give rise to any claim by the Lessee but shall at his own expense carry out all necessary alterations to such roads or paths constructed by him.
